I am trying find an answer to my question – Can my employer advertise my job even though I haven’t resigned?
I am currently moving somewhere else and I asked my employer to give me flexible working hours during this time and this is being considered at the moment however I saw that my job is advertised on job sites online. Is this legal?
They are allowed to do this, yes. They could not make you redundant and then replace you, but if they do decide they cannot give the flexible working hours that you seek, they may assume that you will resign and are looking for a back up plan.
If you are working flexibly, i.e. not holding a full time position anymore, then it stands to reason that they would have to hire another person to fill the gap. They would not be allowed to force you to leave without a reason and then advertise your job. But if you know that you’re going to be moving elsewhere, they know that they have a position that needs to be filled, and therefore needs to be advertised.
