Can employers ask you about your disability at your interview or during your work? Many people’s question is “Can I be asked about my disability at interview?”
Have you had an interview where you were suddenly asked about your sick record, an injury or disability? If so, under the new Equality Act of 2010 that came into force at the start of last October, that would now probably indicate an illegal act of discrimination was imminent.
If you are being quizzed about your disability or health then ask yourself:
If you answered ‘yes’ to any of these then you are not demonstrating that discrimination has taken place.
Take you legal action.
I would always recommend responding with ‘prefer not to say’ on all forms until after interview, so that the company are not taking any disability into consideration. After interview and acceptance, answer with as much detail as possible if you require any support, for example, if you require a specially designed chair, or if you require medication while at work, for example Type 1 Diabetes.
