hi all,
thank you for this forum, its very useful for me already. My redundancy pay has been calculated based on a weekly pay of my contracted 8 hours. However I have been working on average 39 hours a week as overtime since May. I was told by the company that overtime is not included.
However information from various sources (such as the Citizens advice bureau website) states that ‘A week’s pay does not include overtime pay UNLESS the overtime was regular and you have to do it as part of your job’
It is in my employee handbook that I’m expected to do overtime (and also one of the reasons I took redundancy was due to the fact, that i was made to feel I wasnt doing my job properly because i could no longer do any overtime), and having done it for that long surely must be considered ‘regular’.
Does this mean I should get more than they have told me?
Should my weekly pay therefore be considered as an average of my weekly wage, including contracted hours AND overtime, for the 12 weeks before my notice was given?
